Understanding the separation between the house and the land
In leasehold, it is fundamental to understand that the house is not under no circumstances for rent :

Full ownership of the walls (the house): The building, the villa and all its facilities belong to you 100% in full ownership. You are the sole owner of the walls and the structure.

Long-term rental of the land: It is only the land base (the land) which is the subject of a lease agreement with a maximum duration of 30 years, officially registered at the Land Department.
Advantages and Disadvantages of this setup

The Advantages

  • Secure property of the walls: The foreigner is the full owner of his property (the villa), which guarantees him the freedom to resell or transfer it.
  • Legal solution for foreigners: This is the most transparent and common legal framework to allow a foreign national to establish themselves permanently in Thailand.
  • Registered legal security: The lease is recorded in black and white with the land authorities, guaranteeing your rights to occupy and use the land for the entire period.

Disadvantages:

  • Fixed initial duration: Thai law limits land leases to a maximum of 30 years.
  • Anticipation is necessary: The valuation and transfer of the asset require anticipating the 30-year deadline, as renewal options or future lease promises must be framed by rigorous contractual clauses.
  • Educational support is needed for buyers: It is imperative to clearly explain to prospective buyers that while the villa belongs to them for life, the land is subject to this strict time frame.


Freehold

In freehold, the legal situation is direct and absolute:
​Full ownership of the land and walls: Unlike a leasehold, you own 100% and indefinitely both the building (the villa) and the land on which it is built. This is the most complete level of ownership possible.

Benefits :

  • ​​Perpetual and absolute ownership: The property belongs to you indefinitely. There are no lease expiry dates to monitor, which offers complete peace of mind in the long term.
  • ​Tfacilitated inheritance transfer: Full ownership is passed down from generation to generation by inheritance in a very simple way, without the constraints of the end of a land contract.
  • Stable asset value: Because the land retains its value in perpetuity, freehold generally benefits from a perception of maximum security among all buyers.
  • Strong interest from buyers of Thai nationality: Thai buyers are particularly and naturally interested in this type of freehold ownership, which corresponds to the most obvious local legal standards for them, thus considerably expanding the target market.
  • Higher resale price: Because of the perpetual full ownership of the land and the strong appeal of this status to local buyers, the resale price is generally higher than for a leasehold property.

Disadvantages:

  • ​Strict restrictions for foreigners: Thai law prohibits foreign nationals from directly owning land in their own name under freehold ownership. To access land, freehold purchase generally requires the creation of a Thai company.
  • Obligation of conformity and substance (real company): This structure must under no circumstances be a shell company (front company or nominee). It must be a real company, with genuine economic substance and a real Thai director involved in the governance rules, in accordance with strict Thai regulations.
  • Administrative complexity and structural costs: The management and maintenance of this actual legal and fiscal structure generates maintenance costs and annual accounting obligations that must be anticipated.


Which one to choose?

The choice between the leasehold and the freehold It depends primarily on your investor profile, your budget, and your long-term strategy:


Opt for the Leasehold If you’re looking for a simple, quick, and extremely secure way to own 100% of your villa’s walls without the hassle of managing a complex company structure, this is an ideal choice for a smooth investment, with a very active and accessible resale market.


Opt for the Freehold If you wish to hold full and perpetual ownership (land and buildings) and are not deterred by setting up a proper and compliant Thai company structure, this status offers maximum asset value, particular appeal to local buyers, and a generally higher resale price.
